| 内容記述 | This essay consists of five parts (1) preface-explanation of the aim of this essay, (2) development of the public utility concept, (3) economic characteristics of public utilities, (4) public utility status, (5) public utilities and public corporations. The purpose of this essay is to differentiate the economic characteristics of public utilities and the public utility status. The economic characteristics are discussed in the fields of (1) public utility industry itself, (2) public utility capital, (3) public utility services or service goods, (4) public utility expenses. The generally accepted theory concerning the public utility status is (1) economic necessity, (2) monopoly or inadequare competition. Of these two, the first needs but little explanation. Turning to the other characteristic, there are several types of monopoly. First, there is monopoly based on the possession of a special, exclusive franchise. Secondly, there is monopoly based on natural limitations in supply or conditions of service. Finally, the character of utility service makes for economic monopoly. Though monopoly or tendency to monopoly is one of the economic characteristics of public utilities, there is much doubt as to whether monopoly is the touchstone of public interest or not. Mr, Justice Roberts rightly discards monopoly as one of the touchstones of public interest. Prof. Thompson tries to substitute for it the principle of inadequate competition which covers both monopoly on the one hand and excessive competition on the other. In conclusion, the bases of public interest seem to be (1) economic necessity and (2) reasonableness of price and service, as public utilities must provide indispensable services or service goods to the public at a reasonable price and service standard. | |||||||||||
